1. Acceptance of the Terms and Conditions of Use Use of the website www.reservaya.com.do (hereinafter, the "Website") and of the services offered on it implies acceptance of these Terms and Conditions of Use (hereinafter, the "Terms and Conditions of Use") and of the Website's Privacy Policy (hereinafter, the "Privacy Policy"), and the user must therefore read both documents carefully before using the Website and its services. The Website is operated by RESERVA YA (hereinafter, "RESERVA YA"), domiciled in the Dominican Republic. 2. Modification of the Terms and Conditions of Use RESERVA YA reserves the right to modify, update or replace these Terms and Conditions of Use and the Privacy Policy at any time and without prior notice. Such modifications, updates or replacements will be published on the Website and will take effect automatically upon publication. Use of the Website and of the services offered on it after the publication of the new Terms and Conditions of Use and Privacy Policy will imply acceptance of them. 3. Access to the Website Access to the Website is free of charge. However, in order to access certain services offered on the Website, the user must register and create a user account (hereinafter, the "User Account"). The user must complete the registration form with truthful, accurate and up-to-date information (hereinafter, the "Registration Information"). The user undertakes to keep the Registration Information up to date and not to create more than one User Account. The user is responsible for maintaining the confidentiality of their User Account and of the password used to access it. The user is responsible for all activity carried out through their User Account and with their access password. The user undertakes to notify RESERVA YA immediately of any unauthorised use of their User Account or of its access password, or of any other security breach relating to their User Account. RESERVA YA reserves the right to refuse any registration request or to cancel a User Account at any time and without prior notice, for any reason or for no reason, at its sole discretion. 4. Use of the Website The user undertakes to use the Website and the services offered on it in accordance with the law, these Terms and Conditions of Use, the Privacy Policy and the other policies and principles governing RESERVA YA. The user undertakes not to use the Website and the services offered on it for unlawful purposes or for purposes contrary to those established in these Terms and Conditions of Use, the Privacy Policy and the other policies and principles governing RESERVA YA. The user undertakes not to use the Website and the services offered on it to damage, disable, overburden or impair the Website and the services offered on it, or to interfere with other users' use and enjoyment of the Website and of the services offered on it. The user undertakes not to attempt to gain unauthorised access to the Website and to the services offered on it, to other user accounts, to computer systems or to networks connected to the Website and to the services offered on it, by hacking, phishing, password mining or any other means. The user undertakes not to obtain or attempt to obtain materials or information through any means not intentionally made available to the user by RESERVA YA on the Website and in the services offered on it. The user undertakes not to use the Website and the services offered on it to publish or transmit any material containing viruses or any other code, file or computer program designed to interrupt, destroy or limit the functionality of any software, hardware or telecommunications equipment. The user undertakes not to use the Website and the services offered on it to publish or transmit any material that is unlawful, threatening, abusive, defamatory, libellous, slanderous, obscene, vulgar, pornographic, profane or indecent, or that constitutes or encourages conduct that could be considered a criminal offence, give rise to civil liability, or violate any law. The user undertakes not to use the Website and the services offered on it to publish or transmit any material that violates the privacy or publicity rights of third parties, or that infringes any intellectual property right of third parties, including, without limitation, trademarks, copyrights, patents, trade secrets and publicity rights. The user undertakes not to use the Website and the services offered on it to publish or transmit any material that constitutes unsolicited or unauthorised advertising, promotional material, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation. The user undertakes not to use the Website and the services offered on it to publish or transmit any material containing false, misleading or fraudulent information, or that promotes unlawful activities or conduct that is abusive, threatening, obscene, defamatory or slanderous. The user undertakes not to use the Website and the services offered on it to publish or transmit any material that constitutes or contains indications, instructions or recommendations that could be used to commit a crime, that could give rise to civil liability, or that in any other way violate any law. The user undertakes not to use the Website and the services offered on it to publish or transmit any material that constitutes or contains indications, instructions or recommendations that could be used to damage, disable, overburden or impair the Website and the services offered on it, or to interfere with other users' use and enjoyment of the Website and of the services offered on it. The user undertakes not to use the Website and the services offered on it to publish or transmit any material that constitutes or contains indications, instructions or recommendations that violate the privacy or publicity rights of third parties, or that infringe any intellectual property right of third parties, including, without limitation, trademarks, copyrights, patents, trade secrets and publicity rights. 5. Payments, Deposits and Cancellations Some restaurants available on the Website may require payment of an advance deposit in order to confirm certain reservations. The user acknowledges and accepts that such a deposit may be a necessary condition for confirming the reservation, and that the specific conditions applicable to it, including amount, cancellation deadlines and refund policy, are set directly by the relevant restaurant. RESERVA YA acts exclusively as a technological intermediary between the user and the restaurant, facilitating the management of reservations and, where applicable, the processing of payments through external providers. Consequently, RESERVA YA is not responsible for the provision of the services offered by the restaurants, nor for the particular cancellation or refund policies they establish. In the event of cancelling a reservation, the user must abide by the restaurant's specific conditions. Depending on those conditions, the deposit may be fully or partially refundable, or non-refundable in the event of cancellation outside the established deadline or in the event of a no-show. Payments made through the Website are processed by external payment service providers. RESERVA YA does not store sensitive credit or debit card information. The user accepts that any claim relating to the provision of the service, including its quality, availability, cancellation or the refund of deposits, must be addressed directly to the relevant restaurant. RESERVA YA will under no circumstances be liable for losses, damages or harm arising from the cancellation of reservations, changes in restaurant availability or breaches by the restaurants. SMS TERMS AND CONDITIONS By providing a mobile phone number and requesting a verification code through the Reserva Ya platform, the user agrees to receive transactional SMS messages relating to account authentication and security. These messages may include one-time passwords (OTP), sign-in verification codes and account security alerts. Message frequency varies according to the user's activity. Message and data rates may apply. The user may reply STOP to unsubscribe from SMS messages or HELP for assistance. Consent to receive SMS messages is not a condition of purchase. Reserva Ya does not use SMS messages for marketing or promotional purposes under this campaign. Consent to receive SMS is not shared with third parties or affiliates for marketing purposes.
