1. INTRODUCTION At Reserva Ya we value your privacy and are committed to protecting your personal data. This policy sets out how we collect, use and share your information in connection with the advertising and offers of brands promoted on our platform, in accordance with the laws of the Dominican Republic. 2. WHAT INFORMATION DO WE COLLECT? Information that the User provides to Reserva Ya for the purpose of registration and payment in our application, including email, first name, surname, photo or avatar, place and country of residence, address, phone number and the password used to access the site. Any other information the User chooses to send us. 3. USE OF PERSONAL DATA When the User uses or visits the Platform, they authorise RESERVA YA to collect information from them directly (for example, when they search for or make a reservation online). RESERVA YA is also authorised to generate information about the User (for example, information about their device while using the RESERVA YA mobile application). RESERVA YA uses the User's information to provide the Services, tailor their experience, show them reservations made through the Platform and related companies, send them marketing communications, and offer them more relevant advertising and offers that may be of interest. Likewise, by using the Platform, the User authorises RESERVA YA to share their information with restaurants and restaurant affiliates; with related companies; with service providers (including payment processors); with other business partners (including advertising partners); with social network services; and with third-party services or applications used to sign in to their account on the Platform. RESERVA YA is equally authorised to use the information to provide and improve the Services, for marketing purposes, and to facilitate offers and advertising for other services that may be of interest. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. RESERVA YA will maintain technical, administrative and physical security measures designed to protect the User's information. Likewise, it is authorised to retain the User's information while their account is active and for a period of time thereafter, so as to allow them to reactivate their account without loss of information, and as necessary. The User acknowledges that Reserva Ya uses cookies and similar technologies to help RESERVA YA provide the Services, offer the User a more personalised experience and market its own products and Services and those of third parties. Personal data entered into Reserva Ya will be used for the purposes specified in this privacy policy or in the relevant sections of the application. The password used to access the RESERVA YA platform will not be shared. RESERVA YA holds no biometric data file; where biometrics are used on the platform, that storage is carried out by the electronic device from which the User accesses the application and subject to the terms of its operating system. Likewise, we may use the User's collected personal information to: a. Improve the browsing experience by personalising the mobile Application / the website. b. Enable the User to use the services available in the mobile Application / the website. c. Send advertising, marketing and banners from RESERVA YA's clients, sponsors, advertisers and business partners that are of interest to the user. d. Send them notifications by private message specifically requested by the User. e. Send them the newsletter and other communications relating to RESERVA YA that we believe will be of interest to the User, via WhatsApp or any other digital messaging channel. f. Handle enquiries and complaints by and about the User relating to Reserva Ya. g. Where the User chooses to take part in a promotion by a partner brand, and only if they give their express consent when signing up for it, their personal information (email address, phone number and restaurants visited) may be shared with the brand running the promotion, which will use it for marketing, promotions and direct communication with the User. That consent is recorded and the User may withdraw it at any time from their account preferences or by writing to contacto@reservaya.com.do. The foregoing does not extend to the phone number collected and verified in order to complete a reservation, nor to the consent to receive SMS or WhatsApp verification messages, which are never shared with third parties. RESERVA YA will not provide your personal information unless you give your express consent or Acceptance of this Privacy Policy and RESERVA YA's Terms and Conditions. At no time does RESERVA YA store credit card data; this is done by the online payment providers. The User may tell us at any time that they do not wish to receive advertising messages. They may optionally change their preferences in their account settings or click the unsubscribe tab in the advertising messages they receive from the service, in order to stop future Reserva Ya messages, or write to us to unsubscribe at contacto@reservaya.com.do Marketing communications, newsletters and promotional content referred to in this Privacy Policy may be sent by email, push notifications or other channels. The SMS campaign registered for A2P messaging is used exclusively for transactional authentication and account security purposes, including one-time passwords (OTP) and verification messages. Reserva Ya does not send marketing or promotional SMS messages under this campaign. 4. DISCLOSURES At RESERVA YA we may have to disclose information about the user to our agents and IT service providers, insofar as reasonably necessary for the purposes set out in this privacy policy. In addition, we may have to disclose information about the User, namely: a. To the extent that Reserva Ya is required to do so by law. b. In connection with any legal proceedings or prospective legal proceedings. c. To establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention). Except as set out in this privacy policy, RESERVA YA will not supply your personal information to third parties. 5. SECURITY OF YOUR PERSONAL DATA Reserva Ya will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of the User's personal information. The personal information the User provides and RESERVA YA stores, which as stated does not include biometric data, will be held on secure servers behind password-protected firewalls. The transmission of data over the internet is inherently insecure, and RESERVA YA cannot guarantee the security of data sent over the internet. RESERVA YA is responsible for keeping your password and user details confidential. 6. AMENDMENTS TO THE POLICY By using or accessing the Services, or by clicking that they accept or approve this Agreement, the User acknowledges that they have read, understand and agree to be bound by its provisions. Reserva Ya reserves the right to modify these Terms of use at any time, in whole or in part. It is therefore the User's responsibility to periodically consult the latest published version of the Terms of use and to accept the updates made on the platform. Users are deemed to accept the latest version with each new use of the Platform. 7. YOUR RIGHTS The User may notify RESERVA YA by email of their wish that their personal data not be shared. These rights are access to, rectification of and erasure of their data. 8. THIRD-PARTY WEBSITES The User acknowledges that the Platform provides references to other websites of clients, advertisers, sponsors and business partners, in respect of which they release RESERVA YA from all liability regarding access to, use of and content on them. All links provided to other sites are intended solely to give further references about offers, activities and services of interest. The policies and procedures described here do not apply to third-party services. We suggest you contact those sites directly for information about their terms and conditions, privacy policies and other matters. 9. UPDATING INFORMATION If the User's information has changed, they are responsible for amending it in the RESERVA YA Application or Website. This allows the site to work properly. 10. LEGAL BASIS The User acknowledges and accepts that this Privacy Policy is governed by and construed in accordance with the laws of the Dominican Republic, and in line with the following legislation and its amendments: (i) General Law on the Protection of Consumer or User Rights, no. 358-05, (ii) Law No. 172-13, whose purpose is the comprehensive protection of personal data held in files, public registers, databases or other technical means of data processing intended to provide reports, whether public or private, (iii) Law No. 310-14 regulating the sending of unsolicited email, and (iv) Law No. 126-02 on Electronic Commerce, Documents and Digital Signatures of the Dominican Republic. 11. SMS COMMUNICATIONS Reserva Ya may send transactional SMS messages for account authentication, identity verification and account security purposes. These messages may include one-time passwords (OTP), sign-in verification codes and security notifications relating to the user's access to the Reserva Ya platform. SMS consent is obtained directly from the user when they provide their mobile phone number and request SMS verification during registration or sign-in. SMS message frequency varies according to account activity. Message and data rates may apply. The user may reply STOP to unsubscribe from SMS communications or HELP for assistance. Phone numbers collected for SMS authentication purposes are not sold or shared with third parties or affiliates for marketing purposes. Consent to receive SMS is not shared with third parties or affiliates for marketing purposes.
